Turkish pollution fines - Tariff from 1st January 2012 to 31st December 2012

Gard's correspondents in Istanbul, Messrs. Vitsan Mumessillik ve Musavirlik A.S., have recently circulated the new Turkish pollution fines tariff, valid from 1st January 2012 up to 31st December 2012.

The new rates are as follows:

Petrol and petroleum products discharged to sea by tankers

1. Up to 1,000 (inclusive) gross tons:  TRY 62.80 per ton

2. Between 1,000 and 5,000 (inclusive) gross tons: TRY 15.67 per ton

3. Over 5,000 gross tons: TRY 1.52 per ton

Dirty ballast discharged to sea by tankers

1.      Up to 1,000 (inclusive) gross tons: TRY 47.09 per ton

2.      Between 1,000 and 5,000 (inclusive) gross tons: TRY 9.39 per ton

3.      Over 5,000 gross tons:  TRY 1.52 per ton

Petrol/petroleum products and dirty ballast discharged to sea by vessels or any other sea vehicles

1.     Up to 1,000 (inclusive) gross tons:  TRY 31.39 per ton

2.     Between 1,000 and 5,000 (inclusive) gross tons: TRY 6.26 per ton

3.     Over 5,000 gross tons: TRY 1.52 per ton

Garbage and sewage discharged to sea by vessels and any other sea vehicles

1.    Up to 1,000 (inclusive) gross tons: TRY 15.67 per ton      

2.    Between 1,000 and 5,000 (inclusive) gross tons: TRY 3.10 per ton

3.    Over 5000 gross tons:  TRY 0.61 per ton

Notes
According to Turkish law, if a vessel re-offends within three years, the value of the fine will be doubled. In case of subsequent offences the fine payable will be three times the rates listed above. Also, if a dangerous substance is discharged or disposed of at sea, the fine payable will be ten times the applicable rate taking the category of petrol and petroleum products fines as basis.

If a fine is settled within 30 calendar days of it having been imposed, a 25% discount will apply.

On 1st January 2012 the Turkish Central Bank's exchange rate was USD 1 = TRY 1.8876.
